Since September 2000, anyone who sells, serves, delivers, or dispenses alcoholic beverages (including persons who immediately manage, direct, supervise, or control the sale or service of alcoholic beverages) should be TABC Certified so that the business (bar, hotel, restaurant, store, etc.) may continue to receive "Safe Harbor" -- reduced or no fines and penalties related to employee(s) actions.
Section 106.14
Texas Alcohol ic Beverage Code
D&D Training is a TABC-approved course provider for Seller/Server Training and Certification, offering both classroom and online training. We are certified and monitored by the Texas Alcoholic Beverage Commision. The Commision does not actually conduct the classes.
The TABC-approved training course is not mandatory but many employers require their employees to have their certification because it helps protect the employers from liability and promotes the responsible sale/service of alcoholic beverages.
As an employer, what are the advantages of requiring Seller/Server training?
The laws concerning the sale and service to minors and intoxicated persons are covered, as well as interventions that will help ensure that sales/service will not be made to minors or intoxicated persons.
Additionally, TABC will not take administrative action against a license or permit holder when an employee sells or serves an alcoholic beverage to a minor/intoxicated person as long as:
This protection is commonly referred to as "safe harbor." If an illegal sale is made, the seller/server will most probably be arrested, but the employer's permit/license will have protection from administrative action.
